Access to and use of this Website and the services available through this Website (collectively, the “Services”) are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Services, you are agreeing to all of the Terms of Service including the Privacy Policy, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.
This Website also contains links to other websites, which are not operated by Storcx (the “Linked Sites”). Storcx has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

Definitions of Terms

For the purposes of these terms and conditions: ;

the “Giftraising Host” refers to the registered account holder who has created a personal “Gifraising Page” in order to receive financial contributions for themselves or another recipient;

the “GIftraising Contributor” refers to the person making a gift “Contribution” to a Giftraising page

the “Website” is www.storcx.com

the “Giftraising Page” refers to the specific event page created by the Host; it is shared with their Contributors for the purpose of collecting Contributions;

Access to Website

Parts of the “Website” require you to input a password to access certain features. This is to be able to give you details relevant to your Hosting or Contributing Giftraising page whilst still keeping them private to you. To do this, as part of our security procedures, we require you to register an account with Storcx by entering your email and choosing a secure password. We highly recommend that you choose a strong password that is hard for others to guess, and you log out from your account at the end of every session. There is a password reset procedure in case you forget your password. You must treat your account log-in information as confidential, not disclosing it to any third party and only using Company in person. If you think there may have been any breach of security then it is your responsibility to notify us immediately and if log-in is possible, to change your password.

It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete. We reserve the right to disable any user account in our sole discretion, at any time for any or no reason, including if, in our opinion, you have failed to comply with any provision of these Terms of Service.

We do not guarantee that the Website or any content provided on the Website is error free. We manage your personal data according to our

Your privacy is important to us.  Our privacy policy, which sets out how we will use your information, can be found here. By using the Website, you consent to the processing described therein and warrant that all data provided by you is accurate.

Prohibitions

You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Storcx will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Rules regarding anti-money laundering and combating the financing of terrorism

The Issuer is subject to the entire UK & Wales legislation regarding anti-money laundering and combating the financing of terrorism.

In application of the provisions of UK law, relating to the participation of financial institutions in the anti-money laundering and combating the financing of terrorism, the Issuer must obtain information from any User for any transaction or business relationship of the origin, purpose and destination of the transaction or the opening of an account. In addition, it must make all the audit necessary to the identification of the User and, as the case maybe the effective Beneficiary. The latter undertakes to make all audit to allow the Issuer to realize a close examination of the transaction, to inform him/her about any exceptional transaction compared to the usual transactions registered under these rules and to provide him/her with any document or information required.

The User recognizes that the Issuer can stop or delay at any time the use of a login, the access to an Account or the execution of a transaction or a Reimbursement in the absence of sufficient element about its purpose or nature. He/She is informed that a transaction executed under these rules may be subject to the exercise of the right to communicate to the national financial intelligence unit.

The User can, in accordance with the legislation, access all this information communicated subject to such right of access does not challenge the purpose of anti-money laundering and combating the financing of terrorism, where this data concerns the claimant.

Intellectual Ownership

The intellectual property rights in all content made available to you on or through this Website remains the property of Storcx or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Storcx and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Storcx or its licensors. Storcx is a trade marks belonging to Storcx. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are colourably similar without the written permission of Storcx.

Terms of Service

Registration

If you wish to use the website or its associated services to collect money from your friends and family towards a shared goal, you must register with the webiste.  Applications to register with the website can only be accepted from users:

(a) Who are at least 18 years of age.

In order to register with the website you must complete all mandatory areas of the online registration form. We may reject any application for registration from any person at any time, even if such application fulfils our Registration Requirements. If your application for registration is approved, you will receive an email from us to verify your nominated email. You can then change your email and password by logging into the “My Profile” section of the website. This email must be confirmed in

order to activate your registration. By approving your application for registration, we do not warrant or guarantee to any other persons that you fulfil our Registration Requirements.
 
Once you have registered, you will be permitted to create a Storcx Giftrasing Page and start collecting money towards your group gift or cause.

You must:

a) Keep any password or any other private information relating to the site strictly confidential and not disclose it to any third party.
b) Keep your email address and other registration details up to date and notify us of any changes. We will use your email address to contact you about your Storcx giftraising page, any funds you have created and any funds you have contributed.
c) Not do anything to assist any person who is not a registered user to create a Storcx giftraising page.
d) Not create additional registration accounts for the purpose of abusing the functionality of the webite or other users.
e) Not pass yourself off as another user.
 
We have the right to disable any password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms and Conditions and/or if we believe that you do not fulfill the Registration Requirements.
 
Using the Storcx Service
 
Collecting Funds

If you have registered and provided that your account has not been terminated by us, you can create a Storcx gIftraising page and use our services to collect contributions via your Storcx account page. In these Terms and Conditions, you will be referred to as the “Giftraising Host’ 

MangoPay will retain all money contributed via a GIftraising Page. After the deduction of MangoPay’s fees, we will transfer the remaining collected funds to the GIftraising Hosts registered account. In order for a GIftraising Host to collect such funds, the GIftraising Host must click on the “Collect Funds” button on his or her “GIftraising Bank Account” page.  All funds collected by us will be held in GIftraising Hosts’ MangoPay account until you request your collected monies be released into your selected bank account.

Mango Pay Terms of Service Mango Pay Service Contract

The GIftraising Host will not earn, receive or be entitled to any interest on monies raised through their GIftraising page. The GIftraising Host is able to review the transaction history for his or her GIftraising page via the My Transactions Page.  All transaction records are held electronically and can only be viewed through the Site. 

Contributing Funds

If you wish to contribute to your invitation from the Giftraising Host, simply click on the “Contribute” button on your email request page and follow the instructions.  You can pay using most registered debit or credit cards or a bank account.  All payments must be made in GB pounds or US Dollars or Euros. 
   
Fees and Currency Conversion (The following fees apply to the use of the webite and associated services)
 
Storcx charges an admin fee purely to cover the costs of MangoPay Ltd, which is subject to change.

Visa/Mastercard 1.9% + £0.20

Bank Transfer £0.45

CASH-OUT (per transaction)

Flat fee of £0.45

Refunds

Requests for refunds of contributions made to a Storcx page can only be made by the person who has created the Storcx page and not by individual contributors. If the Storcx page creator wishes to have all contributions to his or her Storcx page refunded to the original contributors he or she can do so provided that is before the closing date. We reserve the right to request I.D in the form of a passport, identity card or driving license, for any refund request or for any page that we believe to be fraudulent. Please note that refunds will be made after the deduction of Mangopay transactional fees, so the full amount of any contribution cannot be refunded. 

Responsibility for use of collected money through Storcx

It is the responsibility of the Storcx page creator to correctly use the funds collected through their page. We have no responsibility for the use made by the Storcx page creator of the money collected through their Storcx page, or for any refunds requested by individual contributors. Our only responsibility is to collect contributions and pass them to the page creator.

Responsibility of the Giftraising Host

It is the Giftraising Host’s sole responsibility to collect funds and use the money for what was described on his giftraising page. We have no control over, nor any responsibility for, the use made by the Giftraising Host of all or any of the collected contributions.  Furthermore, it is entirely within the discretion of the Giftraising Host whether or not to refund contributions.
 
We are not responsible for any disputes or disagreements between the Giftraising Host and any contributors. It is a condition of the use of the Site and any of its associated services that any such disputes or disagreements must be resolved directly between yourselves and that you agree not to involve us in any such dispute or disagreement.

Disclaimer of Liability

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Storcx and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Storcx’s liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

Linking to this Website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you.
This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

Disclaimer as to Ownership

Except where expressly stated to the contrary all persons (including their names and images), third party trade marks and images of third party products, services and/or locations featured on this Website are in no way associated, linked or affiliated with Storcx and you should not rely on the existence of such a connection or affiliation. Any trade marks/names featured on this Website are owned by the respective trademark owners. Where a trademark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to Storcx.

Indemnity

You agree to indemnify, defend and hold harmless Storcx, its officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service..

Variation

Storcx shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise: please let us know at info@storcx.com if you have any complaints or comments.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing Law & Jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Storcx. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a company director of Storcx. If you do not agree to these terms you must not use the website; respectively if you use the website you are agreeing to the Terms and Conditions as written hereof.
